LOS ANGELES, California (CNN) -- The man famous for dishing out advice on national television now needs the advice of legal counsel.

TV psychologist "Dr. Phil" McGraw, whose Texas twang and folky common sense catapulted him to stardom, is being taken to court over his discontinued "Shape Up!" diet plan.

Three disgruntled dieters on Monday asked a Los Angeles County Superior Court judge to expand their fraud claim into a national class-action lawsuit. They're seeking refunds and additional damages.

No ruling is expected until next year. If the judge rules in favor of the dieters, the suit would be opened to claims by thousands of followers of Dr. Phil's Shape Up! diet.

The suit alleges that the plan is useless. It called for dieters to take 22 herbal supplements and vitamin pills a day and cost about $120 a month. The plan also advised dieters to adopt a low-calorie diet and to exercise.

The plaintiffs allege that while they lost plenty of money on the plan, they didn't lose any weight.

Unhappy dieters told CNN Radio that after listening to McGraw they believed they could lose weight by taking the pills alone.

McGraw has not commented on the lawsuit. The diet, promoted through a book and television special, was discontinued last year.

Phone calls to Irving, Texas-based CSA Nutraceuticals, which made the Shape Up shakes, bars and multivitamins, were not returned.

i saw something about this on the news last nite... but it said that PHIL says that he didnt get any PROFIT from it... and what he DID get he gave to his foundation for prevention of overweight children or something like that..

hmmmmmmmm

no profit eh... welllllll SOMEBODY sure made some bucks of that deal.... that sounds like an AWFUL lot of money...

i bet they didnt EITHER... but heck.. would YOU?? not if ya didnt want to feel just plain SILLY for buying all the other stuff...

i can understand it in a way tho.... when i started ATKINS i went out and bought anything and EVERYTHING i could that said ATKINS on the label...

oddly enough i didnt use 99 percent of the crap... and the stuff i DID try tasted NASTY...

i did get some of their supplements too...

yeah... color me stupid...*L*

Well, I have to say, I am one person who does not care for Dr. Phil (my friends get mad at me when I call him "Dr. Shill").
BUT: Did they actually think that taking pills alone would work? And do they actually think Dr. Phil was dumb enough to tell them so? I am not familiar with his diet plan, so I don't know, but I really doubt it, personally. He seems a bit too crafty for that.
And on the other side of this, if they win this lawsuit, won't that open the door for a slew of similar suits; I mean, Herbalife and Slimfast and Trimspa...haven't we all tried these and failed? Does that give us the right to sue them? I really doubt it.

Well, all I can say is if you can successfully sue McDonald's and win millions for spilling coffee on yourself (which, common sense will tell you that coffee is HOT and it will burn you)....... then anything is possible. As always, with any diet plan, you have to use some "common" sense....

Darn.... what a way to make money...is there anything you can't sue for??? I must put on my creative thinking cap.

It is crzy, most of the diet plans you read about all end up saying the same thing diet and exercise. Would but there be another way
