Since 1998, Life Services Supplements Inc., the owner of the KETO trademark, has developed, manufactured, marketed and extensively advertised an expanding line of 120+ low-carb KETO branded foods and snacks which are sold through a fast-growing base of more than 7,000 health food stores and supermarkets. Given the overwhelming success of the KETO brand in the marketplace, a number of companies are attempting to ride the trademark coattails of Life Services KETO brand.



Alleging unfair competition, false designation of origin and false description pursuant to 15 USC Sect. 1125(a); N.J. unfair competition under N.J. Stat. Sects. 56:4-1; and N.J. common law trademark infringement, Life Services has filed suit against Natural Organics, Inc. (also known as Natures Plus), a nutritional foods company based in New York State. Life Services is alleging that Natural Organics trademark, Ketoslim, is confusingly similar to Life Services KETO mark.



Life Services has also filed suit against Ketogenics, a nutritional supplement company organized and existing under the laws of the State of Nevada with a place of business in Johnstown, Pennsylvania



Additionally, Life Services is currently petitioning the Trademark Trial and Appeals Board (T.T.A.B.) to cancel the trademark KETOPRO, which the Switzerland corporation, Numico Financial Services, S.A. (Numico) has registered. Life Services alleges that Numicos use of the KETOPRO mark will result in a likelihood of confusion, mistake or deception in the marketplace for nutritional foods.



In filing the lawsuits and other legal actions, the company intends to send the marketplace a clear message to avoid KETO or anything sounding like or looking like KETO when choosing a mark or face an inevitable lawsuit from Life Services Supplements, Inc.

What a good idea, I think I'm going to go register my trademark on the term Healthy(tm) Slim(tm) Weight Loss (tm) and . . . oh what the hey, Super(tm).

I can't beleive they have intellectual property lawyers on their staff who told them that they could protect a trademark on "keto" when it is a descriptive prefix used in this industry.

Good luck Life Services Supplements . . but beware, your Ketoslim is infringing on my trademark of the term "Slim(tm)"
